English speakers buying a property in France
When buying a property in France one should understand that the
transfer
of property is subject to French Law.
Since the French Law differs from the English Law, it often
occurs that several different or even conflicting rules may be applied
to the relationship or situation of the buyers. Under French
law, it is for example impossible to disinherit one's forced heirs
(children, parents, etc..).
Under French Law, the Marital Regime is a set of rules which governs
the interests of spouses during their conjugal life and determines the
division of their assets upon dissolution of the marriage. It may be a
community property regime, based on the principle of joint management,
or a separate estate regime, whereby each spouse is free to manage
her/his own assets.
Who inherits? What are the rights of the surviving spouse? What rights
do creditors have? How is the inherited property disposed of?
How much will be owed in taxes? How much are the total fees?
Your French Notaire, after careful consideration of your personal
situation,
will be able to advise you in the best of your interest and
will answer all the questions you may have regarding inheritance, will,
joint ownership and marital regime. As an expert in Family Law your
Notaire will ensure your security and that of your family and
estate.
